This is the privacy statement of GymKing, located at Concertweg 1A, 2402 JG, Alphen aan den Rijn, registered in the Commercial Register of the Chamber of Commerce under number 57754403, and its affiliated entities.

WHY THIS PRIVACY STATEMENT?
If you have a GymKing membership, are considering signing up, visit our website out of interest, use our app, or interact with our social media, we need certain personal data from you. We aim to be transparent about how we process your personal data, hence this privacy statement. Naturally, GymKing treats your data with the utmost care and complies with the applicable data protection laws, such as the General Data Protection Regulation (GDPR).

Below we have outlined what data we process, the legal grounds for processing, the purposes, and how we handle your data. We also explain how you can exercise control over the processing of your personal data by GymKing.

As a dynamic company in a rapidly developing environment, it’s important that we occasionally update this privacy statement. We reserve the right to change this privacy statement at any time. The most up-to-date version can always be found on our website. We advise you to check this page regularly.

WHAT PERSONAL DATA DO WE PROCESS?
GymKing processes personal data. According to the GDPR, personal data is “any information relating to an identified or identifiable natural person.” This includes all data that can be directly or indirectly traced back to you. We receive this data directly from you when you become a member, visit our website, or contact us via social media.

MEMBER DATA
When you sign up for a GymKing membership, we process your name, address, city of residence, phone number, email address, bank account number, gender, and date of birth.

Even if you are already a member, we continue to process such data. Depending on the services used, we may also process: membership number, language preference, the channel through which you joined, club visit logs, last club visit, membership type, your financial status with GymKing, and your NPS score (if you participated in our satisfaction survey).

APP USAGE
Using our Sportivity app, you scan a static QR code at the entrance with your phone to gain access to the facility. Through the app, you can view your personal details as provided during registration, see your membership information, monitor your financial overview, and receive important push notifications from us when necessary.

ACCOUNT DATA FOR APP ACCESS
As a member, you can easily install our app on your phone and log in using your email address and a self-chosen password. The following data will then be uploaded into the app: name, age, gender, country, language, contact details, membership type, membership number, associated club, and visit history.

CAMERA SURVEILLANCE
We use cameras inside and around our clubs. We are fully aware that surveillance can infringe on privacy, and we act with great care. No cameras are placed in changing rooms, booths, or restrooms. Surveillance is used for safety and to monitor house rule violations reactively—i.e., only when an incident is reported. See our Camera Surveillance Regulations on our website for full details.

ACCESS FRAUD
Our General Terms and Conditions prohibit granting unauthorized access to others by allowing them to follow you through the gate. A penalty equal to a day pass plus a €25 administration fee applies. Repeat offences may result in termination of membership. Cameras near the gates detect such fraud, which is always verified by a designated staff member. The violation is linked to the member’s name and QR code. You’ll receive an email with a payment link. You can request the relevant photo (optionally anonymised). Photos are deleted 28 days after fine payment or membership termination. Request via klantenservice@GymKing.nl

WEBSITE VISITOR DATA
We also process data from website visitors, including any information you enter on our contact page (email address, name, city, location, or phone number).

SOCIAL MEDIA
GymKing maintains profiles on platforms like Facebook, Instagram, and TikTok. You can follow and interact with us via these channels. The relevant platform’s privacy policy applies. For questions or issues, you may contact us via private message. These messages are handled by our customer service team and processed via our member system. Personal data is only shared privately, never publicly.

LEGAL BASES FOR PROCESSING

  • Execution of your agreement with GymKing;
  • Compliance with a legal obligation;
  • Protection of vital interests;

WHY DO WE PROCESS YOUR DATA?

 

SERVICE DELIVERY
We use your data to deliver our fitness services, issue your membership pass, handle questions and complaints, issue and collect invoices, and communicate in your preferred language.

INFORMATION
We use your data to keep you informed, mainly via email or push notifications (sometimes by post or phone). You cannot opt out of essential communications related to your membership.

ANALYSIS & MARKET RESEARCH
We may use your data for research and analysis to improve our services. We may invite you to participate in optional surveys. Participation is always voluntary.

REPORTING
We use member data to conduct statistical analysis and generate management reports. Data is used in aggregate form, meaning it contains no information traceable to individual members.

CONTACT WITH MEMBERS
If you contact us, or we contact you, by phone, email, social media, or other channels, the interaction is recorded. This allows us to assist you more efficiently. For example, with service issues, complaints, payments, or during sales. Phone calls may be recorded for training purposes. You’ll hear a notification if this applies.

LEGAL OBLIGATIONS
We may be legally required to process or share your data, e.g. with authorities like the police during criminal investigations.

OTHER PURPOSES
Should we wish to process your data for any other purpose, we will first ask for your consent.

HOW DO WE SECURE YOUR DATA?
GymKing implements suitable technical and organisational measures to protect your
personal data from loss, destruction, unauthorised access, or unlawful processing. These include access controls, user authentication, password-protected systems, authorisation management, up-to-date software, and regular testing.

HOW LONG DO WE RETAIN YOUR DATA?
We retain your data only as long as necessary for the stated purposes and in accordance with legal retention periods. Data is anonymised or deleted after the retention period expires. Membership data is retained during the membership term.

DO WE USE THIRD PARTIES?
We engage third parties after security/privacy assessments and upon signing a data processing agreement. These parties assist with services such as onboarding, marketing, market research, debt collection, advertising, web analysis, recruitment, customer service, mobile app operation, and payment processing.

DO WE SHARE YOUR DATA WITH THIRD PARTIES?
We do not sell your data. We may be required to share your data with authorities (e.g., police) under legal obligations.

HOW CAN YOU EXERCISE YOUR RIGHTS?
Under the GDPR, you have the right to access, correct, complete, delete, restrict, transfer, or object to the processing of your personal data. Below is a summary of your rights:

ACCESS
You may request a copy of your personal data.

CORRECTION
You may request corrections or additions to incorrect/incomplete data.

DELETION
You may request deletion of your data under specific circumstances (e.g. withdrawal of consent, legal obligation, or unjust processing).

RESTRICTION
You may request temporary restriction of processing in specific situations (e.g. during disputes or pending objections).

DATA PORTABILITY
You may request a copy of your data in a structured, machine-readable format (e.g. CSV, Excel) for use with another provider. This right applies if processing is based on consent or contract and carried out via automated means.

OBJECTION
You may object to processing based on public interest or legitimate interest, especially regarding direct marketing or related profiling.

COMPLAINTS
If you are unhappy with how we handle your data, we prefer to resolve it with you directly. You also have the right to lodge a complaint with the supervisory authority.
